Phi Commerce Private Limited (“Phi Commerce”, “We”, “Our”, “Us”) is a company incorporated in India having its registered office at 2nd Floor, Building No. 4, Commerzone, Off. Airport Road, Yerwada, Pune-411006. Phi Commerce is in the business of, amongst others, providing payment aggregation services- to various businesses, merchants etc. in India and payment technology services to banks, payment service providers, financial institutions and such other entities, in India and outside India
Our “Website” or “Platform” or “Services” includes the Phi Commerce website located at phicommerce.com, software applications or web pages or platforms or payment infrastructure or other products/solutions provided by Us, all or any part of Our payment aggregation or payment technology services, or any other services including public information
For the purpose of the Privacy Policy, wherever the context so requires “You”, “Your” or “User” shall mean user using or accessing (either directly via Us or indirectly via Our Partners) Our Services Our “Partners” include Our clients (merchants, businesses, aggregators etc.), Our payment and business partners, Our vendors etc.
The purpose of this privacy policy (“Privacy Policy”) is to give you information on how and why We or Our Partners collect, process, share and store your Personal Data.
This Privacy Policy is applicable to Users of Our Services.

Section 1 – What Data do We collect
Personal Data: For the purposes of this Privacy Policy, “Personal Data” means any information that relates to an individual, which directly or indirectly, in combination with other information Data Privacy Policy 4 available or likely to be available with Us, is capable of identifying such individual. Depending on who you are (e.g., a merchant, customer, cardholder, consumer, supplier or business partner) and how you interact with us (e.g., telephone, online or offline), we may collect, use, process, transfer and store different categories of Personal Data.
Pursuant to the above, We or Our Partners may collect information different categories of Personal Data. These could typically be:
- Name and Contact Information such as: Name, user ID, age, Telephone/mobile Number, Email Address, Address (es)
- Financial Information such as: Your payment details, Personal bank account numbers, card information, UPI details etc.
- Payment/transaction information such as: card holder name, merchant name and category identifier, shopping and payment information like time, amount, goods purchased, other information provided by You directly or indirectly to Us or provided to Us by banks, merchants or other service providers or business partners
- Log Data such as: Your IP address, location, URL, timestamp information, device data, browsing data etc.; andIdentification information such as: Know Your Customer (KYC) documents such as Permanent Account Number (PAN), GST Number, etc.
- Any other information provided directly or indirectly to us such as account usernames and passwords, data collected via permissible cookies settings, promotion or marketing campaigns, customer service interaction data, etc.
If You send Us personal correspondence, such as emails or letters, We may collect such information into a file specific to You.
We may also collect, use and/or share non-personal data or anonymized data such as statistical or demographic data
Exception to Personal Data: If any information provided by You is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other Applicable Laws, such information shall not be regarded as Personal Data
1.1. We collect Personal Data directly from You in different ways on the Website when You voluntarily submit information such as name, email address, phone number, designation, and company name through the ‘Contact Us’ page of the Website. You may also choose to provide such information via other channels including email, sales partners, surveys, promotions, events, social media etc. By providing such information, the User explicitly consents to the collection, use, processing, sharing and storage of said data by Phi Data Privacy Policy 5 Commerce.
1.2. It is acknowledged and understood that Our Partners may collect Your information when You use Our Services and share with Us. This may include: when You scan a QR code to make payment to Our merchants in furtherance to which we receive Your Personal Data or if You are using one of Our payment products or applications; or enter a competition, promotion or survey or You agree to receive marketing materials to be sent by Us; or are prompted to give Us Your financial information, credit card related or identification information on Our web-checkout/payment pages or via other similar channels to complete a transaction
1.3. We collect Your Personal Data and payment information on our checkout/payment pages or similar channels in order for Us to complete transaction(s).
1.4. We or Our Partners may collect Your Personal Data for conducting fraud, bribery, money laundering or risk assessments etc.
1.5. As a merchant/client, You understand and acknowledge that We collect Personal Data from You when You directly register with Us for availing any products or services including initiating an account-based relationship with Us through the ‘Merchant Login’ page of Our Website. By providing such information, You explicitly consent to the collection and storage of said data and all other related data that may be collected or shared with us is governed by a separate Merchant/Business Agreement with you.
1.6. We may also collect Your Personal Data (e.g., Log Data) for analysis and improvement of Our Services.
URLs: In general, You can browse Our Website without telling Us who You are or revealing any Personal Data about yourself. Once We collect Your Personal Data, pursuant to Your use of Our Service, You are not anonymous to Us. Where possible, We indicate which fields are required and which fields are optional. You always have the option to not provide information for the fields that are optional. We may automatically track certain information about You based upon Your behavior on Our Website / Application. We use this information to do internal research on Our users’ demographics, interests, and behavior to better understand, protect and serve Our users. This information is compiled and analyzed on an aggregated basis. This information may include the URL that You just came from (whether this URL is on Our Website or not), which URL You next go to (whether this URL is on Our Website or not), Your browser information, and Your IP address.
Section 2: What do We do with Your Data
2.1 We use Personal Data to provide the delivery of Our Services to You. We will provide You the ability to opt-out of such uses. We use Your Personal Data to resolve disputes; troubleshoot problems; help promote a safe transaction; collect money; measure interest in Our Services, inform about online and offline offers, market and share updates about Our Services; improve and customize Your experience; detect and protect Us against error, fraud and other criminal activity; enforce Our terms and conditions; and as otherwise described to You at the time of collection.
2.2 In Our efforts to continuously improve Our Platform and Service offerings, we collect and analyze demographic and profile data about Our Users’ activity on Our Website/ application. We identify and use Your IP address to help diagnose problems with Our server, and to administer Our Website. Your IP address is also used to help identify You and to gather broad demographic information.
Section 3 – Consent
3.1 Pursuant to Our separate agreement with Our Partners (clients, merchants, aggregators, business partners, vendors etc.) it is understood that, for the purposes of the Services, the said Partners obtains explicit consent from You, towards the collection and processing of the Personal Data by Us or them. When You provide such Personal Data it is deemed that You have consented to collection, use, processing, sharing and storage of such Data.
3.2 We hold Your Personal Data on servers and by providing us with Personal Data, You consent to the transfer of Your Personal Data to, and its storage on, Our servers.
3.3 In the course of business, if We need Your Personal Data for any secondary reason, We shall specify the reason for requiring such Data. Upon such request, You shall have the option to refrain from revealing such Data to Us.
3.4 You acknowledge that Data provided to third-party accounts by You may be transmitted into Your account with Us on Your authorization for such transmissions and such third-party account Information will be covered under this Privacy Policy.
3.5 If after You consent, either implied or explicit, for Your Personal Data to be used by Us, You change Your mind, You may withdraw Your consent for Us to use such Data, for the continued collection, use or disclosure of Your Data, at any time. Such withdrawal of consent shall be communicated to Us either through an email at support@phicommerce.com or by contacting Us at Our corporate office.
3.6 For collecting, processing (including using and storing), disclosing or sharing your Personal Data as described in this Privacy Policy, we hereby, through this Privacy Policy, seek your consent and give you a notice regarding collecting, processing (including using and storing), and sharing your Personal Data for one or more purposes detailed herein. For any purposes where, as per applicable laws of India, a specific consent is required, we will seek such specific consent from you from time to time.
3.7 You may choose to withdraw or not share Your Personal Data or other information with Us, however, that may restrict Your usage of Our Services
Section 4 – Disclosures
4.1 We may share Personal Data with Our other corporate entities and affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of Our Website, to facilitate joint or co-branded services where such services are provided by more than one corporate entity or for other purpose as required to provide Our Services.
4.2 We may disclose Personal Data of You if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose Personal Data to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to enforce Our Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of Our Users or the general public.
4.3 Your Personal Data may be shared, without obtaining prior consent, with Government agencies mandated under the Applicable Laws or any law in India to obtain Your Personal Data for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences. In which case, the Government agency or authority sends a request to Us stating the purpose of seeking Your Personal Data.
4.4 Your Personal Data so obtained by the Government agency or authority is not published or shared with any third party, unless the disclosure to any third party is required by an order under the Applicable Laws or any law in India for the time being in force
4.5 Retention: Phi Commerce may store your Personal Data for as long as the same is required and is permissible as per the applicable laws in India for the fulfilment of purposes for which we collected it. The retention of Personal Data by Phi Commerce is determined by considering compliance with legal (that is, contractual or statutory or regulatory requirements), accounting and compliance reporting requirements.
4.6 We own all intellectual property rights associated with the Our Website/Services and its contents. No right, title, or interest in any downloaded material is transferred to you as a result of any such downloading or copying. The Website is protected by copyright as a collective work and/or compilation (meaning the collection, arrangement, and assembly of all content on the Website), pursuant to applicable law.
4.7 Our logos, product and service marks and/or names, trademarks, copyrights, and other intellectual property, whether registered or not (“Our IP”), are exclusively owned by Us. Without our prior written permission, you agree not to display or use Our IP in any manner. Nothing contained on this Website or in its content should be construed as granting, in any way, any license, right, or interest to you in Our IP, without our express written permission.
4.8 Applicable law: Your use of this Website and Our Services will be governed by and construed in accordance with the laws of India. Users agree that any legal action or proceedings arising from their use may be brought exclusively in the competent courts or tribunals having jurisdiction in Pune, India, and irrevocably submit to the jurisdiction of such courts or tribunals
Section 5 – Third party services
5.1 We may engage the services of third parties to help Us serve Our customers better. In general, the third-party services providers engaged by Us will only collect, use and disclose Your information to the extent necessary to allow them to perform the services they provide to Us. Where required by applicable law, these third-party service providers will independently obtain Your consent prior to collecting or processing any Personal Data. We shall bear no liability in this regard.
5.2 However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information.
5.3 In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either You or Us. Therefore, if You elect to proceed with a transaction that involves the services of a third-party service provider, then Your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
5.4 Once You leave Our website or are redirected to a third-party website or application, You are no longer governed by this Privacy Policy or Our website’s Terms of Service.
5.5 When You click on third party links on Our Website, We are not responsible for the privacy practices of other sites and for the loss or consequential damage that may be caused to You and encourage You to read their privacy statements.
Section 6 – Security
6.1 To protect Your Personal Data available with Us, We have implemented reasonable security practices and procedures. We follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
6.2 If You provide Us with Your payment instrument information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES 256bit encryption.
6.3 As no method of transmission over the Internet or electronic storage is 100% secure, You acknowledge that We cannot guarantee complete security of all data transmitted or stored with Us and hereby release Us from any and all claims arising out of or related to the unauthorized use of such intercepted data
Section 7 – Changes to this Privacy Policy
7.1 We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Website. Continued use of Our Services after any changes to this Privacy Policy will signify your acknowledgment of those changes and your agreement to be bound by their terms
7.2 If Our Website is acquired or merged with another company, Your Data may be transferred to the new owners so that We may continue to provide Services to You.
